Judge threatens to search German man’s home for drugs
A DISTRICT court judge took the unusual step of threatening to personally visit a German man’s house in Castlebar to see if there were any drugs present.
Judge Mary Devins intimated she was willing to do such when the case of Chrestean Auberach of 23, McCormack Estate, Castlebar was before her.
Auberach, a German national, was before the court charged with possession of €208.60 which was found after a search in his house by Garda Willie Grant, who was acting on confidential information.
The defendant told the court that he had stopped using drugs, at which stage Judge Devins made an inquiry.
“So you mean to say that if we stopped court right now and I, you and some Gardaí went to your house, we would not find any drugs,” she asked.
Auberach said that there would be no drugs there, to which Judge Devins replied: ‘I don’t believe you’.
She said that a first offence of cannabis is dealt with in a certain way and that the routine normally is that two more convictions can leave a person open to up to one year in prison. She said that in Auberach’s case, if she sees him again, she will send him before the Circuit Court, where stricter penalties may be imposed more immediately. At this stage she was told that Auberach was due before the courts again on a similar charge in the near future, to which she said she was not surprised.
The court had heard from Auberach’s solicitor, James Warde, that he is a 28-year-old recently unemployed chef. He had been let go from the Welcome Inn Hotel in Castlebar as a result of the economic downturn, Mr Warde added.
Auberach was directed to pay €200 to Mayo Mountain Rescue and would be given the benefit of the Probation Act if this was done before October 6
